Medical Consent

We are not a replacement for emergency medical services. If you have a medical emergency, seek emergency medical care immediately in person or dial 911 or your local emergency number.
1. Changes to this consent
We may change these terms at any time, as required by law. This may include changing, adding, or removing terms, in response to legal, business, competitive, or other reasons not listed here. Your continued use of the services constitutes acceptance of the then-current version of this consent.
2. Telehealth consent
Telehealth is care that allows patients to access health services remotely, using secure messaging, audio, or audio-video interfaces such as videoconferencing. The electronic systems used incorporate network and software security protocols to protect the confidentiality of patient identification and clinical data, and include measures to safeguard that data and to protect its integrity against intentional or unintentional corruption.
3. Expected benefits
- Improved access to weight-management and metabolic health care by enabling you to receive services across distances and between programs.
- More efficient medical evaluation and management.
- Access to the expertise of a distant clinician.
- Maintaining connections with established providers in other areas.
4. Possible risks
As with any medical service, there are potential risks associated with the use of telehealth. These risks include, but may not be limited to:
- In rare cases, information transmitted may not be sufficient (for example, poor resolution of images) to allow appropriate medical decision-making by the clinician or clinical staff.
- Delays in medical evaluation and treatment could occur due to deficiencies or failures of the equipment.
- In very rare instances, security protocols could fail, causing a breach of privacy of personal medical information.
- In rare cases, a lack of access to complete medical records may result in adverse drug interactions, allergic reactions, or other errors of judgment.
5. What you understand by giving this consent
- The laws that protect privacy and the confidentiality of medical information also apply to telehealth, and no information obtained in the use of telehealth that identifies you will be disclosed to researchers or other entities without your consent.
- You have the right to withhold or withdraw your consent to the use of telehealth in the course of your care at any time, without affecting your right to future care or treatment.
- You have the right to inspect all information obtained and documented in the course of a telehealth interaction, and may receive copies of this information for a reasonable, cost-based fee.
- A variety of alternative methods of weight-management and metabolic health care may be available to you, and you may choose one or more of these at any time.
- It is in your best interest to inform your clinician of any other healthcare providers involved in your medical care.
- You may expect the anticipated benefits from the use of telehealth in your care, but no results can be guaranteed or assured.
6. Patient consent to the use of telehealth
You confirm that you have read and understand the information above regarding telehealth, have had the opportunity to discuss it with your clinician or designated clinical staff, and that your questions have been answered to your satisfaction. You give your informed consent for the use of telehealth in your care and have been offered a copy of this consent for your personal records.
Your continued use of the services constitutes your understanding and acceptance of these terms, and you authorize the use of telehealth in the course of your evaluation and treatment.
7. HIPAA consent
The Health Insurance Portability and Accountability Act (HIPAA) provides safeguards to protect your privacy. This is a plain-language summary; the fuller text is available in our Notice of Privacy Practices.
There are rules and restrictions on who may see or be notified of your Protected Health Information (PHI). These restrictions do not include the normal interchange of information necessary to provide you with services. Additional information is available from the U.S. Department of Health and Human Services at hhs.gov.
We have adopted the following policies:
- Patient information will be kept confidential except as necessary to provide services or to ensure that administrative matters related to your care are handled appropriately. This includes sharing information with other healthcare providers, laboratories, pharmacies, and payers as necessary and appropriate for your care.
- Records are maintained electronically with access limited to authorized personnel and third-party providers acting on our behalf. You agree to the normal procedures used for handling records, PHI, and other documents or information.
- We may remind you of appointments and send service communications by telephone, email, text message, mail, or other convenient means, including notices of policy or procedure changes.
- We use vendors in the conduct of business. These vendors may have access to PHI but must agree to abide by the confidentiality requirements of HIPAA.
- You understand and agree that government agencies or payers may review documents that include PHI in the normal performance of their duties.
- You agree to bring any concerns or complaints regarding privacy to our attention so they can be addressed.
- Your confidential information will not be used for marketing or advertising of products, goods, or services without your written authorization.
- We provide patients with access to their records in accordance with state and federal law.
- You have the right to request restrictions on the use of your PHI and to request changes to certain policies concerning your PHI; however, we are not obligated to alter internal policies to conform to your request.
- We may change, add, delete, or modify these provisions to better serve the needs of both the practice and the patient.
Your continued use of the services constitutes your understanding and acceptance of the terms above and any subsequent changes to these policies. This consent remains in force from the time of acceptance forward.
8. Financial consent and auto-renewal authorization
You understand and accept that, in order to render services, a payment card may be kept on file and that any remaining balances for services rendered shall be paid in full. You authorize Metabolic Health Advisors to submit on your behalf, and to release, any medical records or other information necessary to process your consultation order. Fee schedules and receipts for all professional services are available upon request.
- You authorize us to make invoice adjustments and to charge your account for orders placed, goods received, and services rendered that are not fully covered by third-party vouchers or credits.
- You authorize us to charge your payment card for any unpaid balances due.
- Subscription plans are auto-renewing, and you consent to being automatically charged for the plan you are enrolled in unless you cancel before your payment is processed.
- You certify that you are an authorized user of the payment card provided and agree to contact us before disputing a charge with your card issuer.
Refunds, cancellations, and prepaid plan terms are governed by our Refund & Cancellation Policy, including a full refund less the consultation fee if a clinician determines that treatment is not appropriate for you.
9. Shipping authorization
All prescription medications are dispensed according to state and federal law, with the approval of the pharmacist in charge, and in compliance with all applicable requirements of the relevant medical boards and state boards of pharmacy. By requesting shipping, you agree to hold MedsRX and Metabolic Health Advisors harmless for delays or errors during the shipping process. Medication is considered dispensed and the order completed when it is signed out for shipping, not when it arrives via delivery.
Your continued use of the services constitutes acceptance of these terms, and you give permission for medication to be shipped to you at the address provided in your intake form or any other address you provide.
10. Compounded medications
Medications prescribed through MedsRX may be compounded by licensed U.S. compounding pharmacies. Compounded medications are not FDA-approved and have not undergone the same safety, efficacy, and manufacturing review as branded or generic products. The decision to prescribe a compounded medication is made by an independent licensed clinician based on your medical history and telehealth consultation. MedsRX is not a pharmacy and is not a medical practice.
